Alabama Governor Kay Ivey signed HB 272 into law in 2023, making Alabama the 25th constitutional carry state. The law took effect January 1, 2023. Here's what changed and what didn't:

Still illegal under permitless carry: Carrying while prohibited (felony conviction, domestic violence conviction, mental adjudication), carrying on school property, carrying in police stations and courthouses, and carrying while intoxicated. Permitless carry is not a legal free-for-all โ€” federal and remaining state restrictions still apply in full.

Alabama Open Carry Law

Open carry โ€” carrying a firearm visibly in public โ€” is legal in Alabama without a permit for any person who can legally possess a firearm. This has been the case under Alabama law for years and was reinforced by the 2023 permitless carry law. If you can legally own a gun in Alabama, you can carry it openly without a license, permit, or government approval.

There is no state law requiring a holster, specific carry position, or notification to law enforcement that you are openly carrying. However, practical reality matters: open carry in urban areas of Huntsville, Madison, and Decatur can draw police attention and public concern. Being legal and being wise are different things.

The same prohibited locations that apply to concealed carry apply equally to open carry โ€” no firearms in courthouses, jails, police stations, Kโ€“12 schools, or federal buildings regardless of how you're carrying. Private businesses can also prohibit open carry on their premises by posting notice, and you must leave if asked.

Key distinction: Open carry and concealed carry are treated identically under Alabama's permitless carry law. Both are legal for residents who can legally possess a firearm. The Alabama Pistol License is still worth getting for reciprocity in other states โ€” but for carrying within Alabama, neither a permit nor a license is required.

Employer vehicles and property: Your employer can prohibit firearms in the workplace and in company vehicles. Alabama law does not override private employer policies. Know your employer's rules before carrying to work.

Generally yes, as long as you are not consuming alcohol yourself. Alabama law does not broadly prohibit carrying in establishments that serve alcohol โ€” however, individual establishments can post no-firearms signage and ask you to leave. If posted and you refuse to leave, you can be charged with trespass. The prohibition is on carrying while under the influence of alcohol, not on entering restaurants that serve it.
Alabama does not have a mandatory duty-to-inform law for permit holders. You are not legally required to volunteer that you are carrying during a traffic stop or other law enforcement encounter.
